1. Acceptance of Terms

By accessing or using the Parqcar mobile application, website, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

2. Description of Service

Parqcar is a platform that connects individuals seeking parking spaces ("Renters") with individuals offering parking spaces ("Spot Owners"). We provide the technology platform to facilitate these connections but do not own, operate, or control any parking spaces listed on our platform.

Key features of our Service include:

• Interactive maps showing available parking spots
• Booking and reservation system
• Secure payment processing
• Messaging between users
• Rating and review system

3. Platform Disclaimer & Liability

3.1 Parqcar as a Technology Platform

Parqcar operates solely as a technology platform that enables cities, municipalities, businesses, and individuals to implement smart parking solutions. We provide the digital infrastructure to connect parking space providers with users seeking parking.

Important: Parqcar does not own, operate, manage, or have any direct control over any parking spaces, lots, or facilities listed on our platform. All parking spaces are independently owned and managed by third-party Spot Owners who use our platform to list and monetize their available parking inventory.

3.2 Parking Owner Responsibilities

Each Spot Owner who lists a parking space on Parqcar is solely and exclusively responsible for:

• Property Ownership & Rights: Ensuring they have the legal right and authority to offer the parking space for rental
• Safety & Security: Implementing appropriate security measures for their parking premises, which may include but are not limited to surveillance cameras (CCTV), security personnel, guards, lighting, access controls, and any other protective measures
• Listing Accuracy: Providing accurate, complete, and up-to-date information about their parking space, including location, availability, pricing, dimensions, and any restrictions
• Vehicle Care & Protection: Taking reasonable measures to safeguard vehicles parked on their premises during the booking period
• Insurance & Liability: Maintaining appropriate insurance coverage for their property and any incidents that may occur on their premises
• Legal Compliance: Complying with all applicable local, state, and federal laws, regulations, permits, and zoning requirements related to operating a parking facility
• Condition of Premises: Maintaining their parking space in a safe, accessible, and usable condition

3.3 Vehicle Owner (Renter) Responsibilities

Each user who books and uses a parking space through Parqcar is solely and exclusively responsible for:

• Informed Decision-Making: Evaluating and selecting parking spaces based on their own judgment, location preferences, pricing, reviews, and parking requirements
• Vehicle Security: Securing their vehicle properly, including locking doors, closing windows, and removing or concealing valuables
• Parking Decisions: Making their own autonomous decisions regarding where to park, including assessing the suitability and safety of the parking location
• Personal Property: Taking full responsibility for any personal property left inside the vehicle
• Compliance with Rules: Following all parking rules, instructions, and guidelines provided by the Spot Owner
• Timely Arrival & Departure: Arriving and departing within the booked time window and extending bookings if necessary
• Vehicle Condition: Operating a roadworthy vehicle and not parking vehicles with hazardous materials or in violation of any laws

3.4 Limitation of Parqcar's Role

By using our Service, you expressly acknowledge and agree that:

• Parqcar does not guarantee the safety, security, quality, or suitability of any parking space listed on our platform
• Parqcar is not responsible for any damage to, theft of, or loss involving your vehicle or its contents while parked at any location booked through our platform
• Parqcar is not liable for any actions, omissions, negligence, or conduct of any Spot Owner or their employees, agents, or contractors
• All transactions regarding parking spaces are directly between the Spot Owner and the Renter; Parqcar merely facilitates the connection and payment processing
• Users must exercise their own due diligence when selecting and using parking spaces, and assume all risks associated with their parking decisions

4. User Accounts

4.1 Registration

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information as needed
• Keep your password secure and confidential
• Be responsible for all activities under your account
• Notify us immediately of any unauthorized use

4.2 Eligibility

You must be at least 18 years old to create an account and use the Service. By creating an account, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms.

4.3 Account Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms, engage in fraudulent activity, or for any other reason at our discretion. You may also delete your account at any time through the app settings.

5. For Spot Owners

5.1 Listing Requirements

In addition to the responsibilities outlined in Section 3.2, when listing a parking spot you also represent and warrant that:

• The parking spot is safe, accessible, and as described in your listing
• You will honor all confirmed bookings unless cancelled according to our policies
• You will respond to booking requests in a timely manner
• You will maintain accurate availability schedules

5.2 Pricing and Fees

You set the price for your parking spot. Parqcar charges a platform fee (currently 10%) on each completed transaction. This fee is deducted from your earnings before payout.

5.3 Spot Owner Registration & Document Requirements

Becoming a Spot Owner on Parqcar is completely free. There are no registration fees, subscription charges, or upfront costs to list your parking space on our platform.

Required Documentation

To ensure the safety and legitimacy of all parking spots listed on our platform, and to protect both Spot Owners and Renters, we may require the following documents during the verification process:

• Valid Government-Issued National Identity Card (CNIC/NIC): A clear copy of your valid national identity card to verify your identity. This helps us maintain a trusted community of verified users.
• Proof of Property Ownership: One of the following documents to confirm your legal right to offer the parking space:
  • Property ownership deed or title document
  • Property registration certificate
  • Utility bills in your name (electricity, gas, or water bill)
• Rental/Lease Agreement (for tenants): If you are renting the property, you must provide a valid rental or lease agreement that explicitly permits subletting or commercial use of the parking space. The agreement should include:
  • Landlord's written consent for parking space rental
  • Duration of the lease agreement
  • Property address matching your listing
• No Objection Certificate (NOC): In certain cases, such as apartments, housing societies, or commercial buildings, we may require a No Objection Certificate from the relevant housing authority, building management, or society administration.

Verification Process

Our verification process is designed to be quick and hassle-free:

• Submit your documents securely through the app or our website
• Our team will review your submission within 24-48 business hours
• You will receive notification once your spot is approved and live
• All documents are handled in compliance with our Privacy Policy and applicable data protection laws

We reserve the right to request additional documentation if necessary, and to reject or suspend listings that do not meet our verification requirements or violate our Terms of Service.

5.4 Availability and Cancellations

You are responsible for keeping your availability calendar accurate. If you need to cancel a confirmed booking, you should do so as early as possible. Frequent or last-minute cancellations may result in account restrictions.

5.5 Payouts

Earnings are credited to your in-app wallet after each completed booking. You can withdraw funds to your linked bank account according to our payout schedule. Parqcar is not responsible for any bank fees or delays.

6. For Renters

6.1 Booking Process

In addition to the responsibilities outlined in Section 3.3, when you book a parking spot you also agree to:

• Provide accurate vehicle and booking information
• Pay the agreed-upon price plus any applicable platform fees
• Treat the parking spot and surrounding property with respect
• Review spot ratings and feedback from other users before making your booking decision

6.2 Payments

All payments are processed through our secure payment system (Stripe). By making a payment, you authorize us to charge your payment method for the booking amount plus any applicable fees.

6.3 Cancellations and Refunds

Cancellation policies may vary by listing. Generally:

• Cancellations made more than 24 hours before the booking start time may be eligible for a full refund
• Cancellations made within 24 hours may be eligible for a partial refund
• No-shows are not eligible for refunds

Refunds are processed to your original payment method within 5-10 business days.

7. Prohibited Activities

You agree not to:

• Violate any laws or regulations
• Infringe on the rights of others
• Provide false or misleading information
• Engage in fraudulent or deceptive practices
• Harass, threaten, or intimidate other users
• Circumvent our fee structure or payment system
• Use automated systems to access the Service
• Attempt to gain unauthorized access to our systems
• Upload viruses or malicious code
• Use the Service for illegal parking or activities
• Sublease parking spots without owner permission

8. Spot Ratings & Reviews

8.1 Parking Spot Rating System

Our platform features a parking spot rating system that allows users to rate and review parking spaces after each completed booking. These ratings and reviews are displayed publicly on each parking spot listing to help other users make informed decisions.

The rating system includes:

• Star Ratings: Users can rate parking spots based on their overall experience
• Written Reviews: Users can share detailed feedback about the parking location, accessibility, safety, and their overall experience
• Public Visibility: All ratings and reviews are visible to other users browsing the parking spot

8.2 Review Guidelines

All reviews must be honest, accurate, and based on genuine experiences. By submitting a review, you agree to:

• Only review parking spots you have actually booked and used
• Provide truthful and constructive feedback
• Not include personal information about Spot Owners or other users
• Refrain from offensive, discriminatory, or inappropriate language

We reserve the right to remove reviews that violate these guidelines, are fraudulent or misleading, or violate our Terms or policies. Spot Owners may not offer incentives for positive reviews or penalize users for negative reviews.

9. Intellectual Property

The Service, including its content, features, and functionality, is owned by Parqcar and protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or distribute our content without permission
• Use our trademarks without written consent
• Reverse engineer or decompile our software

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We do not guarantee:

• The accuracy of listings or user information
• The quality, safety, or legality of parking spots
• That the Service will be uninterrupted or error-free
• The conduct of any user

You understand that Parqcar is a platform that facilitates connections between users. We are not responsible for the actions, omissions, or conduct of any user or parking spot.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PARQCAR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits or revenue
• Loss of data
• Vehicle damage or theft
• Personal injury or property damage
• Any damages arising from your use of the Service

Our total liability for any claim arising from your use of the Service shall not exceed the amount you paid to Parqcar in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Parqcar, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of a third party
• Your parking spot listing or booking

13. Dispute Resolution

13.1 User Disputes

If you have a dispute with another user, we encourage you to first try to resolve it directly. You may also contact our support team for assistance. While we may help facilitate resolution, we are not obligated to mediate or resolve disputes between users.

13.2 Disputes with Parqcar

Any dispute arising from these Terms or your use of the Service shall be resolved through binding arbitration, except where prohibited by law. You agree to waive your right to a jury trial and to participate in a class action lawsuit.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where Parqcar is incorporated, without regard to its conflict of law provisions.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Parqcar regarding your use of the Service.
